Temporary Germany Availability Notice:

RasaMall is available to German consumers for a limited period only. During this period, all applicable German and EU consumer protection laws are fully honoured, including the BGB and EU Consumer Rights Directive 2011/83/EU. These rights apply in addition to — and shall not be overridden by — these Terms.

2. Eligibility

By using our website, you confirm that:

• You are at least 18 years of age, or accessing with parental/guardian consent.
• You will provide accurate, current, and complete information for all orders and communications.
• You are not prohibited by any applicable law from entering into a binding purchase contract.

3. Account Registration & Guest Checkout

Creating an account is entirely optional. You may complete any purchase as a guest without registering. If you create an account, you are responsible for the security of your login credentials and all activity under your account.

We collect only personal data necessary to fulfill your order, handled per our Privacy Policy.

4. Products and Services

All products are subject to availability. While we make every effort to display product details accurately, minor variations may occur due to screen settings or manufacturing differences. We reserve the right to modify, suspend, or discontinue any product without prior notice, particularly as our Germany availability is temporary and product ranges may be limited during this period.

5. Contract Formation & Order Process (§ 312i BGB)

Placing an order is a clear multi-step process that lets you review and correct your order before committing:

• Browse & Add to Cart: Select products and add to your cart.
• Review Cart: Review items, quantities, and prices.
• Enter Details: Provide delivery address and payment information.
• Order Summary Page: Before submitting, you will see a full summary including product name, total price (including taxes and delivery), estimated timeframe, and payment method.
• Correct Errors: You can go back and correct any entry before final submission.
• Place Order: Clicking “Place Order / Pay Now” is your binding offer to purchase.
• Order Confirmation: A binding contract is formed only when we send you an Order Confirmation Email.

Contract Storage: Your order details and these Terms will be sent to you via order confirmation email and accessible through your account (if registered).

6. Prices & Payments

All prices are listed in INR (Indian Rupees). For German customers, the INR equivalent in EUR will be shown at checkout based on current exchange rates. Prices include applicable taxes unless stated otherwise. Currency conversion fees charged by your bank or payment provider are your responsibility.

Payments must be completed through secure payment methods available at checkout. We reserve the right to refuse or cancel any order due to pricing errors, unavailability, or suspected fraud. Any payment for a canceled order will be fully refunded.

7. Right of Withdrawal — Germany (§ 312g BGB)

Applies to all German consumers during RasaMall’s temporary Germany availability period.

You have the right to withdraw from your purchase within 14 calendar days of physically receiving your goods — without giving any reason.

To withdraw: Email support@rasamall.com before the 14-day deadline with your name, order number, and delivery date. You may use the Model Withdrawal Form in our Shipping Policy & Return, Exchange & Withdrawal Policy.

After withdrawal:

• Full refund including standard delivery charges within 14 days of withdrawal notice or receipt of returned goods (§ 357 BGB).
• Refund via your original payment method.
• You bear direct return shipping costs to India for change-of-mind withdrawals.

Exceptions: Withdrawal does NOT apply to sealed hygiene goods once unsealed, custom/personalized products, opened perishables, or digital content once delivery has begun.

8. Shipping & Delivery

Full details are in our Shipping Policy & Return, Exchange & Withdrawal Policy. Key points:

• Primary shipping is within India. Temporary Germany shipping is available for a limited period.
• Orders processed within 2–10 business days, Monday–Friday.
• India delivery: 7–10 business days after dispatch.
• Germany delivery: 10–21 business days after dispatch, subject to customs.
• Customs duties for Germany orders are the customer’s responsibility.

9. Intellectual Property

All website content — including text, images, designs, logos, and software — is the exclusive intellectual property of RasaMall, protected under applicable copyright and trademark laws. You may not copy, reproduce, distribute, or exploit any content without prior written consent.

10. Prohibited Activities

You agree not to:

• Use the website for any unlawful or fraudulent purposes.
• Transmit malicious code, viruses, or other harmful data.
• Interfere with or disrupt the website’s systems or networks.
• Collect other users’ personal data without consent.
• Use automated tools (bots, scrapers) to extract or misuse website data.

11. Limitation of Liability

To the maximum extent permitted by applicable law, RasaMall is not liable for indirect, incidental, or consequential damages arising from your use of the website or products. We are not responsible for delays caused by customs, international courier failures, or force majeure events.

Germany consumers: Nothing in this clause limits your statutory rights under mandatory consumer protection law, including your 2-year warranty right under § 437 BGB.

12. Privacy & Data Protection (GDPR)

Your personal data is processed per our Privacy Policy and, for German/EU users, in compliance with the General Data Protection Regulation (GDPR) (EU) 2016/679. We collect only data necessary to fulfill your order. You have the right to access, correct, and request deletion of your data at support@rasamall.com.

13. Online Dispute Resolution (EU ODR)

The European Commission provides an Online Dispute Resolution platform for consumers in Germany and the EU: https://ec.europa.eu/consumers/odr

We are not obligated to participate in alternative dispute resolution but will always attempt to resolve issues amicably via support@rasamall.com first.

14. Governing Law

These Terms are governed by the laws of India. For consumers in Germany, mandatory German and EU consumer protection provisions apply and shall not be overridden by these Terms.

15. End of Germany Availability

Once RasaMall’s temporary Germany shipping window closes:

• No new orders will be accepted from German delivery addresses.
• All existing orders placed during the active period will be fulfilled, and all return/withdrawal rights will be honoured.
• German customers with open warranties or active return windows will continue to receive full support at support@rasamall.com.

16. Changes to These Terms

We reserve the right to update these Terms at any time. The “Last Updated” date reflects any changes. Continued use constitutes acceptance of the revised Terms.
